Website Hosting and Email Terms

This is a structured hosting-agreement template. It must be completed with actual service limits, billing rules, backup scope and provider arrangements before publication.

1. Parties and service

These terms apply between [INSERT LEGAL ENTITY OR OWNER], trading as WebCoZa, and the customer identified in the quotation, order or account record.

2. Hosting fee

The standard small-business hosting fee is R200 per month unless a different amount is agreed in writing. State whether fees are payable monthly in advance, the due date, accepted payment methods and whether prices include VAT.

3. Domain charges

Domain registration and renewal charges are normally billed separately and may change according to the extension, registrar and exchange rate. The customer must keep registration information accurate.

4. Email

State the number of included mailboxes, storage per mailbox, attachment limits, spam filtering, acceptable use, support boundaries and whether archived mail is backed up.

5. Customer responsibilities

  • Pay fees on time.
  • Keep contact and billing details current.
  • Use strong passwords and protect account access.
  • Keep local copies of important business information.
  • Use services lawfully and avoid spam, malware and prohibited material.
  • Maintain licences for paid software not supplied by WebCoZa.

6. Backups

Describe exactly what is backed up, how often, where it is stored, how long it is retained, whether restoration is included and what is excluded. Do not describe backups as guaranteed unless the service genuinely supports that promise.

7. Availability and maintenance

Services may be interrupted for maintenance, faults, security incidents or third-party failures. State any service-level commitment only if it is measured and contractually supported.

8. Security

WebCoZa takes reasonable security measures but cannot guarantee that hosting or email will never be compromised. Customers must report suspected incidents promptly and cooperate with password resets or protective action.

9. Resource limits and fair use

Define storage, traffic, CPU, memory, email sending and other limits. WebCoZa may require an upgrade or restrict harmful use that affects other customers or the underlying provider.

10. Suspension

State when services may be suspended, including non-payment, abuse, security risk, unlawful content or material breach. Explain notice and restoration fees where applicable.

11. Cancellation

State the required notice period, final billing, data-export process, migration assistance, domain transfer process and how long data is retained after termination.

12. Ownership and access

Document domain registrant details, administrative access, website files, database, content, premium software licences and any elements supplied under restricted licences.

13. Support

State support hours, contact methods, expected response approach and what falls outside hosting support, such as website redesign or third-party application training.

14. Changes and price reviews

Explain how customers will be notified of price or service changes and the notice period that applies.

15. Disputes and law

Insert a South African governing-law and dispute-resolution clause appropriate to the business and consumer-law obligations.
